Member benefits (the "Services")
When you become a Single Shot member of Espresso Fiction, you
are entitled to receive
When you become a Double Shot member of Espresso Fiction, you are entitled to receive:
You agree that all the information you provide is accurate and that you are over 18 years of age.
Payment, renewal and cancellation
Monthly payment will be by credit card and membership will commence from the
date merchant authorisation is received. You may cancel your subscription
in writing within 90 days and receive a full refund. You may cancel your
subscription after this period but will not be eligible for a refund.
Participation in online discussion boards
If you have access to our discussion boards through a Double Shot membership,
you agree not to post any message or material that is unlawful, libellous,
defamatory, abusive, threatening, vulgar, obscene, profane, racially offensive
or infringes any copyright. Espresso Fiction in its sole discretion and without
notice to you may remove any message or material that it finds unacceptable.
You will indemnify and hold harmless Espresso Fiction from any claim, suit,
damage, loss or expense (including reasonable attorneys' fees) arising out
of any breach or any allegation which if true would constitute a breach of
any of the foregoing warranties or representations.
Intellectual property rights
All of the content and materials provided by and through the Services are the
sole and exclusive property of Espresso Fiction (or third parties that have
granted Espresso Fiction the right to distribute such material), and is protected
by applicable intellectual property laws and other laws. "Content" means
any information, mode of expression or other materials and services including
but not limited to our stories, message boards, software, graphics, and any
and all other features of the Services.
You may make a copy of our Content for your personal, non-commercial use, provided that the material copied is not altered and remains intact, including any copyright notices and disclaimers. Any other copying, distribution, storing, or transmission of any kind, or any sort of commercial use of our Content is prohibited without express written permission.
You agree that Espresso Fiction has an unlimited license to republish anything you post on our site. We'll only republish your posts in context and we'll credit you (under your username) as author. We won't republish your posts for advertising purposes without your permission.
You agree not to display Espresso Fiction's trademark or use it in any manner without our express written permission.
Modifications
Espresso Fiction may modify any of the terms contained in this Agreement, including
but not limited to the cost of membership and the member benefits, at any
time at our sole discretion. We'll notify you of any material changes via
email and/or by posting an announcement on the site. Any changes we make
will be effective within fourteen (14) days after notice has been provided.
If any modification is unacceptable to you, your only recourse is to terminate
this Agreement. Your continued use of the Service following notification
of such change will constitute your binding acceptance of the new term.
Warranties
Espresso Fiction expressly disclaims all warranties of any kind whether express
or implied including, but not limited to, warranties that:
. the Services will meet your requirements or expectations.
. the Services will be uninterrupted or error free.
To the fullest extent permitted by law, neither Espresso Fiction, nor any of
its owners or employees will be liable for any damages resulting from or in
connection with your use of the website.
Duration of Agreement and Termination
This Agreement will become effective subject to its terms and conditions upon
acceptance of this Agreement by clicking on the "I ACCEPT" button
and it will remain in effect for as long as you continue to subscribe to
Services and you continue to use the Services according to the terms of this
Agreement. Espresso Fiction may terminate this Agreement for any reason,
including, but not limited to, if Espresso Fiction finds that you have violated
any of the terms of this Agreement.
This Agreement shall be governed by the laws of Australia .
Acceptance Procedure
I have read and agree with all of the terms and conditions of this Agreement
(please click the button below marked "I ACCEPT"). This will constitute
a binding agreement, enforceable according to its terms.
